RISK WARNING — RECREATIONAL SERVICES

Warning under the Australian Consumer Law and the Civil Liability Act 2002 (NSW):

Under the Australian Consumer Law (New South Wales), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you are rendered with due care and skill and are reasonably fit for any purpose which you, either directly or by implication, have made known to the supplier or a person acting on behalf of the supplier.

If you sign this form, you agree that these statutory guarantees do not apply to you to the extent permitted by law.

Note: The change to your rights, as described above, does not apply if your death or injury is caused by the reckless conduct of the supplier.

Activities Covered: Ocean surf coaching (including beach breaks, reef breaks, and point breaks), surf skate coaching, pool-based coaching and training, beach-based warm-ups, fitness exercises, and any related travel to and from session locations.

Locations: Beaches, ocean, public and private swimming pools, public recreation parks and skate facilities, and other locations as communicated for specific sessions on the Northern Beaches of Sydney and surrounding areas.

1. Acknowledgement of Risks

I understand and acknowledge that the activities listed above involve inherent and significant risks of physical injury, illness, permanent disability, or death, including but not limited to:

• Drowning or near-drowning
• Impact with surfboards, surf skateboards, the ocean floor, rocks, reef, or other objects
• Impact with other participants or members of the public
• Slips, falls, collisions, and loss of balance
• Marine life encounters (including but not limited to jellyfish, sharks, and stingrays)
• Changing ocean conditions including waves, currents, rips, tides, and wind
• Changing weather conditions including lightning, extreme heat, and poor visibility
• Equipment failure or unsuitability
• Injuries sustained during warm-ups, land-based exercises, or travel to and from session locations
• Sun exposure, dehydration, and hypothermia
• Pool-related hazards including impact with pool edges, tiles, or other users

I voluntarily assume all such risks, both known and unknown, associated with participation in Yugen Surf coaching activities.

2. Medical Fitness and Disclosure

I declare that I am physically fit to participate, have disclosed all relevant medical conditions, and am not aware of any condition that would make my participation unsafe. Yugen Surf reserves the right to refuse participation if there is a reasonable belief that participation poses a safety risk.

3. Swimming Ability

I confirm that the participant can swim a minimum of 200 metres unassisted in open water.

4. Emergency Consent

In the event of illness, accident, or emergency, I authorise Yugen Surf staff to provide or arrange first aid, medical treatment, ambulance transport, or hospital admission as deemed reasonably necessary.

5. Release of Liability

To the maximum extent permitted by law, I release and discharge Yugen Surfboards (ABN 47 817 821 526), trading as Yugen Surf, and its owner, employees, contractors, agents, and volunteers from all claims arising out of or in connection with my participation in coaching activities. This release applies except where injury or death is caused by reckless conduct.

6. Indemnity

I agree to indemnify and hold harmless the Released Parties against any claims arising out of or in connection with my participation, except to the extent caused by reckless conduct.

7. Media Consent

I grant Yugen Surf permission to use photographs, video, and other media of the participant taken during coaching sessions for promotional, marketing, and educational purposes. To opt out, notify info@yugen.surf before your first session.

8. Privacy

Personal information will be handled in accordance with Yugen Surf's Privacy Policy at yugen.surf/privacy.

9. Duration

This waiver remains in effect for all coaching activities with Yugen Surf until revoked in writing to info@yugen.surf.

10. Minors

If the participant is under 18, this form must be completed and signed by a parent or legal guardian.
